Ticket Returns – Event Tickets
The following refund terms apply to the return of tickets for events with a fixed date:

General Terms and Conditions – Events
These terms and conditions apply to the organisation of events at and around Café Sand and in all areas managed and operated by Café Sand or by Hal över Betriebsgesellschaft mbH, and to all related deliveries and services provided by Hal över Betriebsgesellschaft mbH, hereinafter referred to as “Hal över”.
1. All verbal and written agreements regarding events, catering services, the course of events and further deliveries and services are binding on both the organiser and Hal över.
2. All prices include statutory VAT. Any statutory increase in VAT after conclusion of the contract shall be borne by the client.
3. A deposit of 10% of the expected invoice amount is payable upon conclusion of the contract. Where necessary, a further deposit may be required prior to the event.
4. Invoices issued by Hal över are payable within 7 days of the invoice date without deduction.
5. Our buffet catering is calculated on the basis of a minimum of 30 guests. Where this minimum is not reached, a surcharge on the buffet ordered will be charged per participating person.
The organiser must notify Hal över of the final number of participants no later than five working days before the event date to ensure careful preparation. Where the notified number of participants is reduced within 72 hours of the start of the event, 50% of the agreed catering services will be invoiced; where the reduction occurs within 24 hours, 100% of the catering services will be invoiced. Should the actual number of participants exceed the notified number without prior notification to Hal över, Hal över accepts no responsibility for the adequate provision of food and beverages or for the staffing of the event.
6. Should the event be unable to take place through no fault of Hal över, Hal över retains the right to reasonable remuneration, depending on the time at which the event is cancelled and the additional services, in particular catering, that had been arranged. Cancellations by the organiser must be made in writing.
For cancellations less than 3 months before the event, Hal över charges a processing fee of 10% of the expected invoice amount; less than 1 month before the event, 30% of the expected invoice amount; up to 10 days before the event, 75% of the expected invoice amount. For cancellations made less than five days before the start of the event, 80% of the agreed services will be charged.
7. In the event of official orders, laws or decrees – for example, but not limited to, in connection with the German Infection Protection Act (Infektionsschutzgesetz) – contractually agreed services may also be amended unilaterally by Hal över in order to comply with the laws, regulations or decrees applicable at the time of performance. Such amendments may include, among others: changes to the table or seating arrangements, e.g. to comply with distancing rules; a prohibition of dancing; a prohibition of self-service at buffets; a limitation of the number of participants; the wearing of protective clothing and/or masks by guests and/or staff; restrictions or prohibitions on the serving of beverages (e.g. a ban on alcohol) and on the food offered (e.g. a ban on dishes that are not fully cooked). As a general rule, no claim to a price reduction and/or compensation exists for the recipient of services (customer) in these and comparable cases.
However, Hal över will always endeavour to coordinate any necessary changes with the recipient of services (customer) ahead of the event, insofar as this can be considered practicable and reasonable.
Should an event be unable to take place because it is explicitly prohibited under official orders, laws or decrees applicable at the time of performance (e.g. closure of hospitality businesses), neither party – Hal över nor the recipient of services (customer) – shall have any claim to compensation against the other. Any claims against third parties (e.g. public authorities) remain unaffected.
Where events can or may take place subject to restrictions, the cancellation conditions (see clauses 5 and 6) shall apply as a general rule, even if such restrictions affect the intended character of the event.
8. Where all-inclusive events exceed the agreed duration, any services not included in the package will be charged on an itemised basis.
9. Should the organiser require more staff than Hal över would typically deploy, the additional costs arising from this shall be borne by the organiser.
10. The organiser is liable for any losses or damage caused by auxiliary staff or by event participants in the same way as for losses or damage caused by the organiser themselves. It is the organiser’s responsibility to take out adequate insurance; Hal över may request proof of such insurance. Hal över reserves the right to charge cleaning and/or repair costs to the organiser where applicable.
The installation of decorative materials, banners, flags or other items must be approved by Hal över. Regardless of whether installation is planned outside or inside, any text and/or imagery forms part of such approval. Hal över may prohibit the installation and/or use of such items.
The client guarantees that all decorative materials in particular comply with fire safety requirements; in case of doubt, Hal över may request confirmation from the relevant fire safety authority. Hal över is liable for the loss of or damage to items brought along only in cases of fault, within the scope of the statutory provisions. Fireworks, Bengal flares, sparklers or comparable items must not be used or stored in or around Café Sand. The same applies to all types of items whose possession and/or use in public spaces is prohibited or subject to statutory provisions.
11. Where Hal över procures technical or other equipment from third-party providers on behalf of the organiser, it does so in the name and for the account of the organiser. The organiser is responsible for treating such equipment with care and returning it in proper condition, and shall indemnify Hal över against all third-party claims arising from the provision of such equipment.
12. The organiser is not permitted to bring their own food or beverages to events. In exceptional cases, a deviating written agreement may be reached; in such cases, a service charge or corkage fee will be charged, the amount of which will be agreed with Hal över and will reflect the lost revenue.
13. Publications containing invitations to job interviews, sales events or references to other events require the prior written consent of Hal över. In the event of unauthorised publication that materially affects the interests of Hal över, Hal över reserves the right to cancel the event; in such cases, clauses 5 and 6 of these General Terms and Conditions shall apply.
14. Hal över is entitled to cancel or terminate an event where there are justified grounds to believe that the smooth operation, safety or reputation of the company is at risk, or in the event of force majeure.
15. Responsibility for the supervision of children rests with their parents or accompanying supervisors.
16. Hal över holds the right of domicile. Instructions issued by staff must be followed.
17. The place of performance and the place of jurisdiction shall be the registered seat of Hal över.
18. Should any provision of these General Terms and Conditions be found to be invalid, the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects its intended meaning. These General Terms and Conditions form an express part of the contract. They are publicly displayed and will be provided by Hal över upon request.
